Terms of Service
EmberMap is operated by IDI-Tech LLC ("we", "us"). By purchasing or using EmberMap you agree to these terms.
Licence. The EmberMap plugin is distributed under the GNU General Public License v2 or later. A Pro subscription grants you a licence key entitling you to Pro feature activation, software updates and support for as long as the subscription is active. You may use your licence on sites you own or manage.
Acceptable use. You are responsible for what you configure EmberMap to collect and for having the necessary legal basis and disclosures for collecting it from your visitors.
Availability and updates. EmberMap is software you host. We do not guarantee uninterrupted operation of your site, and we are not responsible for conflicts caused by other plugins, themes or server configurations. We aim to keep EmberMap compatible with supported WordPress and PHP versions.
Warranty and liability. The software is provided "as is", without warranty of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, our total liability arising from your use of EmberMap is limited to the amount you paid us in the twelve months preceding the claim.
Termination. You may cancel at any time. We may suspend a licence for non-payment or for use that breaches these terms.
Changes. We may update these terms; material changes will be reflected by the date below and, for active subscribers, communicated by email.
Governing law and forum. These terms, and any dispute arising out of or relating to the use, payment or provision of EmberMap, are governed by the laws of the State of California, without regard to its conflict-of-laws rules and excluding the U.N. Convention on Contracts for the International Sale of Goods. Any such dispute shall be brought and litigated exclusively in the state courts of the State of California located in the County of Kern, or, where federal subject-matter jurisdiction exists, in the United States District Court for the Eastern District of California. Each party irrevocably consents to the personal jurisdiction of those courts and waives any objection based on improper venue or forum non conveniens.
Scope of the forum clause (Cal. Civ. Code §1670.15). The paragraph above applies only to disputes concerning the use, payment or provision of the goods and services supplied under these terms. It does not apply to any other claim, and nothing in these terms limits a right or remedy that cannot lawfully be limited.
Talk to us first. Before filing, you agree to email support@embermap.io and try in good faith to resolve the dispute for at least thirty (30) days. Either party may still bring an individual action in a small claims court of competent jurisdiction, including in the county where the defendant resides. Nothing here waives any party's right to a jury trial.
Severability. If any provision of these terms is held unenforceable, the remainder stays in force.
